1. General
Cherry Noir ("we", "us", "our") is a latex and atelier studio based in the Netherlands, registered at Pannekeetweg 16, 1704PL Heerhugowaard (Chamber of Commerce number: 42026286 · VAT number: NL005440146B91). These terms govern all purchases made through our website and all services booked through our consultation and appointment system. By using this website or placing an order, you confirm that you are at least 18 years of age and agree to be bound by these terms.
2. Orders & Pricing
All prices are listed in Euros (€) and are inclusive of VAT where applicable. We reserve the right to update pricing at any time without prior notice. A contract between you and Cherry Noir is formed only upon written confirmation of your order. We reserve the right to decline or cancel any order at our discretion.
3. Custom & Bespoke Orders
All bespoke, custom-made, and made-to-measure pieces are produced to your individual specifications. As such, these items are strictly non-returnable and non-refundable once production has commenced. By placing a bespoke order, you confirm acceptance of these terms. A deposit may be required before work begins.
4. Returns & Exchanges
Ready-to-wear items may be returned within 14 days of receipt, provided they are unworn, unpolished, in their original condition, and returned in the original packaging. Items must be returned at the customer's expense. We do not accept returns on latex garments that show signs of wear, damage, or contact with silicone products, as this may compromise hygiene and material integrity. Exchanges are subject to stock availability.
5. Shipping & Delivery
We ship from the Netherlands. Delivery timelines are estimates only and may vary due to production time, carrier delays, or customs processing. Cherry Noir is not liable for delays outside our control. Risk of loss or damage passes to the customer upon handover to the carrier. International customers are responsible for any import duties or taxes applicable in their country.
6. Latex Care & Hygiene
Latex garments require specific care. Cherry Noir is not responsible for damage caused by improper handling, storage, or use of incompatible products (such as oil-based lubricants, which will permanently damage natural latex). Care instructions are provided with every order.
7. Appointments & Consultations
Atelier appointments and consultation sessions are subject to availability and must be booked in advance. We reserve the right to reschedule or cancel appointments due to unforeseen circumstances. No-shows or cancellations with less than 24 hours notice may result in the forfeiture of a deposit.
8. Intellectual Property
All content on this website — including designs, photography, copy, and branding — is the property of Cherry Noir and may not be reproduced, distributed, or used without prior written consent.
9. Limitation of Liability
To the fullest extent permitted by law, Cherry Noir shall not be liable for any indirect, incidental, or consequential damages arising from the use of our products or services. Our total liability shall not exceed the value of the order in question.
10. Governing Law
These terms are governed by the laws of the Netherlands. Any disputes shall be subject to the exclusive jurisdiction of the Dutch courts.
